Court dismisses MK Party's challenge to Mchunu's suspension and Madlanga Commission

Double whammy for Jacob Zuma's MK Party after the court dismissed its application to contest Police Minister Senzo Mchunu's suspension and the establishment of the Madlanga Commission.

The Pretoria High Court has dismissed the uMkhonto weSizwe (MK) Party’s application contesting the suspension of Police Minister Senzo Mchunu, as well as its challenge to the establishment of the Madlanga Commission of Inquiry.

The court did not rule in the party's favour despite arguments that President Cyril Ramaphosa acted unlawfully in deciding to remove Mchunu.

According to court documents, the court found that the party failed to vindicate any constitutional infringements.


In July, Ramaphosa announced Mchunu's suspension as Minister of Police following allegations of his involvement in organised crime. Professor Firoz Cachalia has since been placed as acting South African Police Service (SAPS) Minister.

Mchunu has further denied any wrongdoing.

Ramaphosa also set up the Madlanga Commission to investigate allegations of corruption and political interference in the SAPS, following an explosive media briefing held by KwaZulu-Natal police chief, Lt-Gen Nhlanhla Mkhwanazi in July.
