The family of a two-year-old toddler who drowned in a water-filled trench near Masakeng location in Valspan is seeking legal advice to hold the Phokwane municipality accountable for her death.
A community activist, Maleke Montshiwagae, said the treacherous trench that was situated close to the residential area had never been cordoned off.
"It is believed that the girl followed her father when he went to relieve himself outside. It was dark, and no one was aware that she had left the house when she fell into the trench that was dug for the installation of sewer pipes. It was already too late when they realised that she was missing.”
The toddler’s mother, Deoiwe Cekiso Duyalvame, said that the family had consulted a lawyer to institute a claim of negligence.
“We were visiting family in Jan Kempdorp when the incident took place, as we had relocated to Potchefstroom. The water was very deep. My daughter Amkhitha Duyalvame was small and could not swim.”
She added that no one was prepared to accept responsibility for the death of her youngest child, who was buried on August 2.
Spokesperson for Phokwane municipality, Kgalalelo Letshabo, said the municipality had not contributed towards the burial expenses.
“We did offer moral support and paid homage to the family. “
She indicated that a contract was awarded in 2023 for the installation of a bulk sewer outfall line, refurbishment of the pump station and construction of a new pump station.
“The work is still ongoing to address sewage spillages in Masakeng. The municipality will only be able to comment upon the conclusion of the investigation.”
SAPS Northern Cape spokesperson Colonel Cherelle Ehlers said the Jan Kempdorp police had opened an inquest into the death of a two-year-old girl on July 26 at approximately 9.10pm in Masakeng in Jan Kempdorp.
“It is alleged that the child was playing outside her residence. Her parents reportedly went to look for her and found her in a water-filled trench. The investigation continues,” she stated.
