INTEGRATIVE medical practitioner Dr Fabian Royston Tun, 55, was sentenced in the Specialised Commercial Crimes Court in Kimberley yesterday after entering into a plea agreement for failing to submit tax returns to the South African Revenue Service (Sars) between 2015 to 2022.
Tun was found guilty of eight counts of failure to submit personal income tax and 42 counts of failure to submit value-added tax (VAT) returns for his practice.
Magistrate Vernon Smith sentenced him to two years imprisonment for failing to submit his personal income tax returns, suspended for five years on condition that he is not found guilty of a similar offence.
On the charge of failing to submit VAT returns, Tun was sentenced to a fine of R10,000 or four months imprisonment per charge, of which a R5,000 fine or two months imprisonment was suspended for five years on condition that he is not convicted of a related offence during this time.
Tun was ordered to pay the first instalment of R5,000 to the clerk of the court in Kimberley starting on October 7.
He will be required to pay off the monthly instalments until the combined fine of R210,000 is settled or serve a seven year prison sentence.
It was noted that Tun had submitted all outstanding returns to Sars prior to sentencing.
He was convicted on June 24 following investigations that were conducted by the Criminal Investigations Unit of Sars in Bloemfontein.
